These Terms of Service ("Terms") govern your use of ColdCraft ("Service") operated by Dave Clancy ("us," "we," or "our"). By accessing or using our Service, you agree to be bound by these Terms.

ColdCraft is a SaaS platform that provides AI-powered cold email automation for B2B sales teams. Our service includes:

• Performance analytics and reporting
• SMTP integration and deliverability tools

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for:

• Safeguarding your account password
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Maintaining accurate account information

4. Acceptable Use Policy

ColdCraft is designed exclusively for B2B (business-to-business) communications.You agree to use our Service only in accordance with these guidelines:

4.1 Permitted Uses

• B2B sales outreach and prospecting
• Professional business communications
• Lead generation for business purposes
• Following up on business inquiries

4.2 Prohibited Uses

• No spam: Sending unsolicited bulk emails or messages
• No B2C marketing: Consumer marketing or personal emails
• No illegal content: Fraudulent, deceptive, or illegal communications
• No harassment: Threatening, abusive, or harassing content
• No false information: Impersonation or false sender identity
• No malicious content: Viruses, malware, or phishing attempts
• Violating anti-spam laws (CAN-SPAM, GDPR, etc.)

4.3 Compliance Requirements

You are solely responsible for ensuring your email campaigns comply with all applicable laws, including:

• CAN-SPAM Act (United States)
• GDPR (European Union)
• CASL (Canada)
• Local anti-spam and data protection laws

4.4 Required Email Elements

All emails sent through ColdCraft must include:

• Accurate sender identification
• Clear and honest subject lines
• Unsubscribe mechanism
• Your physical business address

5. Payment Terms

5.1 Billing

• All fees are charged in advance on a monthly or annual basis
• Payments are processed securely through Stripe
• Fees are non-refundable except as stated in our refund policy
• You authorize us to charge your payment method for all fees

5.2 Free Trial

• New users receive a 7-day free trial
• No credit card required for trial signup
• Trial accounts have limited features and usage
• Trial converts to paid subscription unless cancelled

5.3 Price Changes

We may change our fees at any time. We will provide at least 30 days notice before any price increase takes effect.

6. Refund Policy

We offer a 30-day money-back guarantee for new subscribers:

• Full refund available within 30 days of first payment
• Refunds processed within 5-10 business days
• Account will be cancelled upon refund
• Refunds do not apply to renewal payments
• Abuse of refund policy may result in account termination

7. Service Availability

We strive to provide reliable service with minimal downtime:

• Target uptime of 99.9% (excluding scheduled maintenance)
• Scheduled maintenance will be announced in advance
• We are not liable for downtime caused by third-party services
• No guarantees of continuous, uninterrupted service

8. Data Ownership and Privacy

You retain ownership of all data you upload to ColdCraft:

• Your content remains your property
• We may use your data only to provide the Service
• You can export your data at any time
• Data handling is governed by our Privacy Policy

9. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of ColdCraft and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law:

• ColdCraft shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
• We are not responsible for deliverability issues caused by your SMTP configuration
• We are not liable for compliance violations or legal issues arising from your use
• You use the Service at your own risk

11. Indemnification

You agree to indemnify and hold harmless ColdCraft, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your email campaigns and their compliance with applicable laws

12. Termination

12.1 Termination by You

You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of your current billing period.

12.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, if you:

• Violate these Terms
• Use the Service for prohibited purposes
• Fail to pay applicable fees
• Engage in abusive or harmful behavior

12.3 Effect of Termination

Upon termination, your right to use the Service will cease immediately. We may delete your data after a reasonable notice period.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Spain.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide reasonable notice of material changes. Continued use of the Service after changes constitutes acceptance of the new Terms.
